AI does not change who is responsible
HIPAA does not carve out a separate rule for AI. If a vendor's AI creates, receives, maintains or transmits PHI for a clinic, it is a business associate, and so is each subcontractor that touches that PHI on the vendor's behalf. HHS's business associate guidance says a BAA must flow down the chain from covered entity to business associate to subcontractor.
That makes the subprocessor list the most useful document to ask for: which model providers, telephony carriers and hosting services handle your callers' audio and text.
Questions to put to any AI vendor
- Will you sign a BAA before we route a single patient call?
- Who are your subprocessors, and are they under BAAs too?
- Is our call data used to train models? The answer should be no.
- What is stored (audio, transcript, summary), where, and for how long?
- Who in our clinic can see transcripts, and is access logged?
- What happens to a call the AI cannot handle? There should be a clear handoff to a person.
- Does the AI diagnose or give clinical advice? It should not.
Your own risk analysis still applies
HHS's risk analysis guidance expects a clinic to identify where ePHI lives and what threatens it. Adding an AI receptionist adds a system to that inventory. Write down what it collects, who reviews it, and how a patient reaches a human.
How FrontDeskClinic's AI receptionist is set up
These are the controls on our published pages.
- A Business Associate Agreement on every plan at no extra charge.
- Your calls, transcripts and documents are never reused to train AI models, and data stays scoped to your clinic.
- End-to-end encryption and audit trails, as listed on our FAQ.
- A public subprocessor register at /legal/subprocessors.
- The AI answers 24/7, screens spam, answers common questions from the knowledge base you upload, books and reschedules appointments, takes detailed messages, and transfers warmly to your team when a human is needed.
- Urgent triage escalation and VIP caller routing, with call summaries and transcripts you can review.
Frequently asked questions
- Can an AI receptionist be HIPAA compliant?
- Yes, when the vendor signs a BAA, safeguards the data as the Security Rule expects, and the clinic includes the system in its own risk analysis. The technology itself is not what HIPAA certifies.
- Is our patient data used to train the AI?
- Not at FrontDeskClinic. Calls, transcripts and documents are never reused to train AI models.
- Where can I see which vendors touch our data?
- Our subprocessor register is published on the Subprocessors page.
- Does the AI give medical advice?
- FrontDeskClinic's AI handles reception tasks: questions from your knowledge base, scheduling, messages and transfers. It routes urgent matters to your team.
